How his drinking near the time of the arrest could have affected his BAC depends on a lot of other variables. But his BAC was high enough that he thought that resisting arrest was a good idea, which makes me think that overall it was too high for his chugging to have much effect.

But I agree with you that it&#039;s not a slam dunk, and even if the other facts are favorable to the prosecution, these sorts of cases are annoying to try because you have to bring in experts and explain how the body processes alcohol, etc. If he hadn&#039;t resisted arrest, I would think they&#039;d offer him a decent plea agreement. A friend of a friend had a similar experience (cops encountered him outside of his car, punching a wall) and got a &quot;wet reckless.&quot; 

And I agree that this case is much better than most DUI cases, for the defense at least.]]></description>

		<description><![CDATA[I am not an attorney, but my understanding is that (at least here in PA) sitting in the driver&#039;s seat with the car running is operating the vehicle, whether you are actually seen driving.

Grey:  I just saw Kurkjian on ESPN talking about Michael Young.  Basically, Timmy was sawing that if Young is not traded, Young will still get 600 ABs playing all over the field.  Paraphrasing, he said that he thinks the plan would be a lot of DH, a day here at short, a day there at second, some days at third, etc.  

My question is how would it affect Young&#039;s value if he ended up with 2B and/or SS eligibility later on in the season?]]></description>

And I don&#039;t know how your state is (or Florida for that matter) but Illinois is not a zero tolerance state.  You can drink and drive, you just can&#039;t be impaired or legally drunk while driving.  With the toxicology reports possibly being skewed and the fact that there are no witnesses that I&#039;m aware of to prove the State&#039;s case that he was driving and was impaired while doing so, this is a case I would gladly roll the dice on and take to trial.  Not saying it&#039;s a slam dunk, as generally no case is, but it&#039;s a helluva better defense than most people have when it comes to DUIs.]]></description>

In a league which counts BB&#039;s and NSB&#039;s (instead of SB), would you prefer one of Fielder, A-Gon, or Teix, all who should give good OBP&#039;s (and thus BB&#039;s), or would you still take someone like Wright over them?

My reasoning for doing the former is that the few steals that some of these first rounders like Wright provide are diminished if they get caught stealing somewhat frequently.

I have the 11th pick in a 14 team league, so I&#039;m pretty sure one of Zimmerman or A-Rod will fall back to me.]]></description>

And that got me thinking the only other player I can think of who always has that f&#039;ing grin on his face is Andruw Jones. Then I realized they are both (and the only 2 in ML history) from the tiny island of Curacao!?  Do they force children to constantly have a shit-eating grin on their face or what? I&#039;m definitely thinking you are going with the 2nd option there.  The league is a 7x7 that includes hits and OPS so I was starting to think that Reynolds was going to hurt me with his .200 avg.  And if I like the 2nd duo that much better, it would probably cost me like a 6th round pick in our draft (after we keep 8).]]></description>
